1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the ListingVideo website, applications, and related services (collectively, the “Service”) operated by ListingVideo. By creating an account, uploading photos, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy.
If you are using the Service on behalf of a brokerage, agency, or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization. If you do not agree to these Terms, you may not use the Service.
We may update these Terms from time to time as described in Section 13. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
2. Who can use ListingVideo
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for real estate professionals, photographers, and related businesses producing marketing material for properties they are authorized to represent.
You agree to provide accurate, current, and complete information during registration and to keep that information up to date. We reserve the right to suspend or terminate accounts that we reasonably believe violate these eligibility requirements.
3. Your account
You are responsible for safeguarding the credentials used to access your account and for all activity that occurs under it. You agree to notify us promptly at hello@trylistingvideo.com of any unauthorized use or suspected breach of security.
We are not liable for any loss or damage arising from your failure to maintain the confidentiality of your credentials. You may not share, sell, or transfer your account to any other party without our prior written consent.
You may close your account at any time from your account settings. Closing your account does not relieve you of obligations accrued prior to closure, including outstanding fees.
4. Your content
You retain all ownership rights in the photographs, text, branding, and other materials you upload to the Service (“Your Content”). By uploading Your Content, you grant us a limited, non-exclusive, worldwide license to host, process, reproduce, and modify it solely for the purpose of operating and providing the Service to you.
You represent and warrant that you own or have the necessary rights and permissions to upload Your Content and to grant the license above, and that Your Content does not infringe the rights of any third party. You are solely responsible for the accuracy and legality of any property information you submit.
We do not claim ownership of the videos generated from Your Content. Subject to payment of applicable fees, the finished videos are yours to use, distribute, and display.
5. Acceptable use
You agree not to misuse the Service. Without limiting the foregoing, you may not:
- Upload content you do not have the right to use, or that is unlawful, deceptive, or infringing;
- Attempt to reverse engineer, decompile, or otherwise discover the source code of the Service;
- Use the Service to generate material that misrepresents a property or violates fair-housing or advertising regulations;
- Interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorized access to it;
- Resell, sublicense, or commercially exploit the Service except as expressly permitted in these Terms.
We may investigate and take appropriate action, including suspending or terminating accounts, against anyone who, in our sole discretion, violates this section.
6. Billing & refunds
Certain features of the Service are offered on a paid basis. Fees, billing frequency, and the features included in each plan are described at the point of purchase and may be updated from time to time. All fees are stated in U.S. dollars and are exclusive of applicable taxes unless otherwise noted.
You authorize us and our payment processor to charge the payment method on file for all fees incurred. Except where required by law, payments are non-refundable once a video has been rendered and delivered. If you believe you have been charged in error, contact hello@trylistingvideo.com within 30 days and we will review your request in good faith.
7. Subscriptions & cancellation
Subscription plans renew automatically at the end of each billing cycle unless cancelled before the renewal date. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you will retain access to paid features until then.
We may change subscription pricing with reasonable advance notice. If you do not agree to a price change, you may cancel before it takes effect. We do not provide refunds or credits for partial billing periods except where required by law.
8. Intellectual property
The Service, including its software, design, templates, trademarks, and all related intellectual property, is owned by ListingVideo or its licensors and is protected by applicable laws. These Terms do not grant you any right, title, or interest in the Service other than the limited right to use it as described herein.
You may not use our name, logos, or branding without our prior written permission, except to identify the Service as the source of videos you have produced through it.
9. Third-party services
The Service may integrate with or link to third-party products, platforms, or services, including listing portals, social networks, and payment processors. We do not control and are not responsible for the content, policies, or practices of any third party.
Your use of third-party services is governed by their respective terms, and we encourage you to review them. Integrating a third-party service is at your own risk.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.
You are responsible for ensuring that any video you publish complies with applicable real estate advertising, disclosure, and fair-housing requirements in your jurisdiction.
11. Limitation of liability
To the maximum extent permitted by law, ListingVideo and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
12. Governing law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue in those courts.
Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your place of residence.
13. Changes & contact
We may revise these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. By continuing to use the Service after revisions take effect, you agree to the updated Terms.
